Pets: HOA policy allows 1 dog under 30 pounds. No cats due to frequent allergies to them. There is an extra guest fee above 6 guests. Pet Policy: A one-time non-refundable pet fee of $150 is required for guests bringing a dog. Only one dog is allowed per stay. Prior to check-in: 1. Community Rules and Information for Short Term Guests 1.Only guests known to management may be on the property. 2. Park in assigned spaces only. 3. No smoking indoors or anywhere outside where other guests may be affected. 4. Neighbors must not be disturbed. Citywide noise ordinance is between 10pm and 7am. A noise monitoring service will be used. 5. Supplies will be stocked at the start of the stay. If new supplies (such as toilet paper or laundry soap) are needed this will be the responsibility of the guest to purchase additional supplies. 6. Use older, multi-colored towels for outside. Keep white towels inside. 7. Storing or parking of personal powered water craft must have prior approval. 8. Grill must be cleaned by guest if used. Do not move grills. 9. Return any used equipment or furniture to it’s original place after use. 10. Report any damage or missing items so it can be remedied quickly. 11. Keep all areas clear of clutter and garbage. 12. Garbage and recycling is picked up on Mondays. 13. Paddleboards must be kept upside down unless and until they are in 6” of water to prevent damage to the fins. 14. Warning: No lifeguard on duty! Guests and their guests swim at your own risk. Water shoes are recommended as broken glass has been found in the past. Children under 13 must be supervised at all times when by the water. 15. Warning: Sledding is dangerous and frozen lake water is not monitored for safety. Supervise children and sled at your own risk. The use of the facilities at Cross Lake Estates naturally involves the risk of injury, whether the undersigned or someone else causes it. As such, the undersigned agrees that he or she understands and voluntarily accepts the risk and agrees that Cross Lake Estates and any of their affiliated entitles or an officer, director, member, agent, servant or employee (hereinafter collectively “Cross Lake Estates”) will not be liable for any injury, including and without limitation, personal, bodily, or mental injury, economic loss or any damage to the undersigned, the undersigned’s spouse, the undersigned’s children, guest or relative (hereinafter, collectively “Guest”) resulting from the negligence of Cross Lake Estates or anyone else using the facilities. If there is any claim by anyone based on any injury, loss, or damaged described herein, which involves GUEST, the undersigned agrees to (A) – defend Cross Lake Estate against such claims and pay Cross Lake Estates for all expenses relating to the claim including, but not limited to, any and all attorney’s fees, and (B) –Indemnity Cross Lake Estates for all obligations resulting from such claims. This document shall be construed and enforced in accordance with the laws of the State of Minnesota. Any action at law, suit in equity, or other jurisdictional proceeding arising in connection with this document shall be instituted only in the courts of Pine City, MN. Waiver of Liability The GUEST agrees to release from all liability, discharge and promise not to take legal action against (i) Cross Lake Estates, (ii) any other guest, visitor, or person present using the facilities or equipment of Cross Lake Estates; and/or (iii) any designers, manufacturers or installers of the facilities or equipment of Cross Lake Estates; This agreement releases Cross Lake Estates from any liability to GUEST, their heirs, next of kin, assigns or personal representatives for any losses or damages or claims or demand arising out of GUESTS personal injuries, damage to property or GUESTS death, even if Cross Lake Estates’s individual or collective negligence contributes to such personal injury, damage or death. The undersigned hereby waives any and all claims or actions that may arise against Cross Lake Estates, its owners, directors, or employees or volunteers as a result of any such injury to any such person. Such risks include, but are not limited to: 1) Injuries resulting from the negligence of the owners, operators, employees, or volunteer assistants of Cross Lake Estates or the negligence of guests, visitors or persons who may be present at Cross Lake Estates; or the negligence of the landlord or Cross Lake Estates 2) Injuries or death resulting from the failure or negligent misuse, by me or by others, of the facilitators or equipment or Cross Lake Estates; 3) Injuries caused from slips, trips, falls, or other such accidents that occur while using the facilities or which may be caused by other persons’ use of the facilities or equipment of Cross Lake Estates 4) Injuries that occur from the negligence or lack of adequate training of those volunteers, agents, or employees of Cross Lake Estates who seek to assist with medical or other help with before or after injuries have occurred. The GUEST freely and voluntarily assumes complete personal responsibility for these risks and for the injuries that might occur as a result of these risks, even if such injuries occur in a manner that is not foreseeable at that time this agreement is signed. At the end of July when the water get warmer the lake “blooms” with algae. Our less than five star reviews have been because of this and not having a resort quality beach . Please judge our place on the accommodations, we cannot control the water quality and the HOA prioritizes a natural shoreline. Our kids swim off the dock and have fun in the water, but if your kids are used to swimming pools they may not like to swim here. Always wear water shoes.
